PREAMBLE

These General Terms and Conditions of Sale (hereinafter referred to as the “Terms and Conditions”) govern the contractual relationship between:

(hereinafter referred to as “the Seller”)

and any natural or legal person making a purchase on the website www.vignobles-jdbibian.com (hereinafter referred to as “the Buyer” or “the Client”).

These Terms and Conditions apply without restriction or reservation to all sales of products offered by Vignobles Jean Denis Bibian on its website, including wines from Châteaux Sémeillan Mazeau, Lagrave Cissan, and Jander.


ARTICLE 1 – DEFINITIONS

In these Terms and Conditions, unless otherwise stated, the following terms shall have the meanings set out below:

  • “Site”: refers to the website www.vignobles-jdbibian.com
  • “Products”: refers to all wines and other items offered for sale on the Site
  • “Order”: refers to the purchase of Products by a Client on the Site
  • “Customer Account”: refers to the Client’s personal space on the Site
  • “Terms and Conditions”: refers to these General Terms and Conditions of Sale

ARTICLE 2 – PURPOSE AND SCOPE

These Terms and Conditions define the rights and obligations of the parties regarding the online sale of the Products offered by the Seller.

They are accessible at any time on the Site and take precedence over any other document. They may be modified at any time by the Seller. The applicable version is the one in force on the date of the Order’s confirmation.

By placing an Order, the Client acknowledges having read and accepted these Terms and Conditions without limitation or reservation.

Purchases made on the Site are strictly reserved for individuals of legal age (18+), in accordance with applicable laws on alcohol sales.


ARTICLE 3 – PRODUCT FEATURES

Products offered for sale are listed on the Site with detailed descriptions of their main characteristics, subject to availability.

Wines mainly come from the following estates:

  • Château Sémeillan Mazeau (AOC Listrac-Médoc)
  • Château Lagrave Cissan (AOC Listrac-Médoc)
  • Château Jander (AOC Moulis-en-Médoc)

Product images and illustrations on the Site are for reference only and are not contractually binding.

As wines are natural products, their color, aroma, and taste may slightly vary between vintages. These natural differences are not considered defects.

The Seller commits to providing accurate information on each wine, including:

  • Vintage
  • Appellation
  • Grape variety or blend
  • Tasting notes
  • Food and wine pairing suggestions
  • Serving and storage advice

ARTICLE 4 – PRICES

Prices are listed in euros, including all applicable taxes (VAT), but excluding delivery fees. VAT is applied based on the rate in effect at the time of the Order.

Prices may change at any time but will be billed based on rates in effect at the time of confirmation.

Delivery costs are specified during the Order process before final confirmation and vary based on destination, weight, and volume.

Volume discounts are clearly indicated on the Site where applicable.


ARTICLE 5 – ORDERS

5.1 Order Process

To place an Order, the Client must:

  • Select Products and add them to the cart
  • Review and adjust the cart as needed
  • Validate the cart
  • Log in or create an account
  • Enter shipping information
  • Choose a delivery method
  • Choose a payment method
  • Review and confirm the Order

The sale is final only after the Seller confirms the Order and receives full payment.

5.2 Modifications and Cancellations

Any changes or cancellations after confirmation are subject to Seller approval. Requests must be sent by email (contact@vignobles-jdb.com) or phone (+33 (0)5 56 58 01 12).

5.3 Product Availability

Products are offered subject to availability. If a Product becomes unavailable after ordering, the Client will be notified and may choose to:

  • Receive a replacement product of equivalent quality and price
  • Receive a refund within 14 days

ARTICLE 6 – CUSTOMER ACCOUNT

Creating a Customer Account is required to place an Order.

The Client agrees to provide accurate and complete information and to update it if necessary.

The Client is solely responsible for keeping login credentials secure and must immediately notify the Seller of any unauthorized use.


ARTICLE 7 – PAYMENT TERMS

7.1 Payment Methods

Payments can be made via:

  • Credit card (Visa, MasterCard, Carte Bleue)
  • PayPal
  • Bank transfer

For card payments, the charge is processed upon Order confirmation.

7.2 Payment Security

The Site uses a secure payment system to ensure data confidentiality and transaction safety.

7.3 Retention of Title

Products remain the property of the Seller until full payment is received.


ARTICLE 8 – DELIVERY

8.1 Delivery Zones

Products are delivered within mainland France and selected EU countries, subject to local alcohol sale laws.

8.2 Delivery Times

Delivery times are indicated at checkout and vary depending on destination and delivery method.

Estimated times:

  • Mainland France: 2–5 working days
  • EU countries: 5–10 working days

These are estimates and may be affected by external factors (weather, strikes, etc.).

8.3 Delivery Fees

Fees are calculated based on destination, weight, and volume. They are shown clearly before final validation.

Free shipping may apply above a minimum order amount.

8.4 Delivery Tracking

A tracking number is provided by email after shipment.

8.5 Receipt of Goods

Clients must inspect Products upon delivery. In case of damage or missing items, they must note precise reservations on the delivery slip and notify the Seller within 48 hours at contact@vignobles-jdb.com.


ARTICLE 9 – RIGHT OF WITHDRAWAL

9.1 Withdrawal Period

Clients have 14 days from delivery to exercise their right of withdrawal without needing to justify or pay penalties.

Clients can notify their decision via:

Products must be returned in original packaging, in perfect condition, with all accessories and documents, within 14 days of withdrawal notice.

Return shipping costs are at the Client’s expense.

9.4 Refunds

Refunds are issued within 14 days of receipt of goods or proof of shipment.

Refunds use the original payment method unless the Client agrees otherwise.


ARTICLE 10 – WARRANTIES

10.1 Legal Conformity Warranty

The Seller provides the legal conformity warranty under Articles L. 217-4 to L. 217-13 of the French Consumer Code.

In case of non-conformity, the Client may choose between repair or replacement (Article L. 217-9).

10.2 Hidden Defects Warranty

The Client may invoke the warranty against hidden defects (Article 1641 of the French Civil Code) and opt for rescission or price reduction (Article 1644).

ARTICLE 11 – LIABILITY

The Seller is not liable for indirect damages resulting from use of Products purchased on the Site.

The Seller shall not be held liable in case of force majeure or unforeseeable circumstances beyond its control.


ARTICLE 12 – INTELLECTUAL PROPERTY

All content on the Site (texts, images, logos, etc.) is the exclusive property of the Seller or its partners. Any reproduction or use, in whole or in part, is prohibited without prior written consent.


ARTICLE 13 – PERSONAL DATA

The Seller commits to protecting Clients’ personal data in compliance with the French Data Protection Act and the GDPR.

Data collected is necessary for Order processing and customer service and may be shared with relevant partners.

Clients have the right to access, rectify, oppose, or delete their data by emailing contact@vignobles-jdb.com.

ARTICLE 14 – ALCOHOL AND HEALTH

The Seller reminds Clients that alcohol abuse is dangerous and should be consumed in moderation.

Alcohol sales to minors under 18 are strictly prohibited. By ordering, the Client confirms they are of legal age.

Proof of age may be requested upon delivery. If age cannot be confirmed, delivery may be refused.


ARTICLE 15 – WINE STORAGE

The Seller recommends the following for proper wine storage:

  • Constant temperature between 10–15°C
  • Humidity between 70–80%
  • Protected from light and vibrations
  • Horizontal storage for corked bottles

These are non-binding recommendations and the Seller cannot be held liable for improper storage.


ARTICLE 16 – APPLICABLE LAW AND DISPUTES

16.1 Applicable Law
These Terms and Conditions are governed by French law.

16.2 Mediation
In case of dispute, the Client should first contact the Seller for an amicable resolution. Clients may also use a free mediation service offered by the Seller.

16.3 Jurisdiction
If no resolution is reached, disputes shall be submitted to the competent French courts.

ARTICLE 18 – FINAL PROVISIONS

If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force.

Failure by the Seller to enforce any part of these Terms shall not constitute a waiver of its rights.
